McGuinness & Associates, Inc. is a licensed and insured private investigation agency (Agency License A-85-00209). The agency was established in 1985 and is a general investigation firm that handles a wide variety of civil (plaintiff and defense) and criminal (state and federal) matters. In addition to law firms, corporations and insurance companies, the agency has worked for newspapers, investigative television and political candidates.
Brian P. McGuinness, owner/director, worked in the major crimes section of the Miami-Dade County Public Defenders Office from 1978 to 1985. He has experience in a wide range of civil and criminal investigations spanning 29 years. He holds several investigative certifications and has been Court qualified in several areas as an expert witness. In 1995, he obtained the CLI Certified Legal Investigator designation by examination and submission of a white paper through the National Association of Legal Investigators, considered the premiere investigative association in the U.S. Brian is also an advocate for the private investigative profession through his former position as president and later board chairman of the National Council of Investigation and Security Services. He is a long term legislative committee member for NCISS and also a legislative committee member for the National Association of Legal Investigators. He has lobbied Congress, held meetings with the Federal Trade Commission with other NCISS representatives and testified before Congress and a Federal Judicial Commission on legislative issues that are important to the profession.
Carolina Hamshaw, also known as Carolina Garcia-Aguilera to her many readers is a successful mystery writer and accomplished investigator with over 15 years experience. She has a successful series of books wherein the central character is Lupe Solano, a Cuban-born Miami private investigator. Carolina has an MBA degree and a great deal of experience in financial investigations. She broke onto the mystery writing scene in 1996 with the critically acclaimed Bloody Waters followed by Bloody Shame, Bloody Secrets, A Miracle in Paradise (Won the Flamingo Award for Best Mystery Novel set in Florida), Havana Heat (Won the Shamus Award for Best Private Eye novel written in 2000) and others. Her eighth book was recently released by HarperCollins and is selling quite well. She has put down her pen temporarily, rolled up her sleeves and is handling a wide range of cases for McGuinness & Associates. Karen Payne, a former investigative reporter with the Miami News is an associate member of the firm and licensed through the agency. While with the Miami News, she handled the Federal Court beat. Ms. Payne has extensive journalistic investigative experience and experience within our agency on civil and criminal defense cases. Karen is an excellent researcher who has assisted our agency greatly, most recently on a high profile criminal defense case. She speaks fluent French, conversational Spanish and conversational Creole, which is useful within Miami's Haitian community.
